Why do I hire paralegals?

2 words come to mind when I think of hiring for my law office’s success. HUMBLE AND
TEACHABLE.

I hire paralegals because overall I find them humble and teachable. Humble does not have
anything to do with competency or mental ability. Being humble allows you to build up from the
inside rather than be puffed up from the outside. Humble means you have a thirst and
appreciation for knowledge. That knowledge brings power so you can help clients. Humble
means accepting that you might not know everything. Not knowing everything is not a weakness
because it allows you to spot issues and ask questions to dig deeper into the problem. Then you
can research the issues with the facts you gathered from your questions. Now you are thinking
out of the box and can bring those ideas to the attention of the attorney to see what can be done
to help the client. Humble means admitting that you made a mistake. Own it, do whatever you
need to fix it and move on.

I remember when I worked in the trust department at Harris Bank as a law student many years
ago. I felt that the more I learned, the more I realized how much more I did not know. I went to
my mentor at the bank and I asked him how to get around this feeling of in adequacy. He said
you don’t have to know everything or pretend to know everything. Just be able to spot issues so
you know how to ask the right questions. Just tell your client that you will get back to them after
you have had a chance to research the issue.

On this same note, I remember back in law school my real estate professor said in giving us
some of her wise advice in the practice of law. She said “A paralegal with experience is far more
valuable to a firm than an attorney who just passed the bar exam.”

That is why I decided to give every future paralegal who comes to my office an opportunity to
intern with us. Allowing them a chance to gain experience and be valuable to a future law firm.
I especially prefer interns from Harper because I know they have learned the skills needed to
research, talk to clients and ask the right questions. They listen and are teachable at our office.
An internship is also a great opportunity to see if there is a good fit. It is a win-win situation for
both of us.

Being part of an honor society like LEX says to your future legal profession that you have that
love of knowledge. Knowledge that leads to asking questions and having the power needed to
help a future employer and clients.

In summary, I hire paralegals at my office because they are humble, teachable, they listen well,
ask questions, and make clients feel that their case is the most important one that they have by
spotting problems and asking the right questions.

The Law Office of Constance M Doyle wanted to make an official statement and have our clients be aware of some the new updates from U.S Citizenship and Immigration Services on I601A Provisional unlawful presence waivers.

As of this last month Immigration just increased processing times for the I601A Provisional unlawful presence waivers. They have increased expected wait time to 44 months plus, with only 80% of the cases being processed.

We know this can be frustrating, as always we will keep you updated if anything changes.

Temporary Protected Status protects about 400,000 immigrants from less than a dozen countries who reside in the US. TPS, as this program is known, allows these individuals to stay in the United States due to dangerous conditions in their homelands. These conditions can range from political strife to violence to natural disasters.

Currently, the Trump administration has expressed reservations about continuing TPS for individuals from certain countries whose status is up for renewal soon. At particular risk are immigrants from Haiti, where conditions due to recent earthquakes have made returning there difficult, as well as refugees from war-torn Sudan. Without renewal, TPS for Haitians ends in January, and for Sudanese shortly thereafter.

Up next in 2018 are large populations of immigrants who have obtained TPS from El Salvador (over 250,000 individuals) and Honduras (more than 80,000). No indications have been forthcoming from Washington as to possible future action or inaction with respect to these persons.

TPS is worth watching. Given the current administration’s hostility towards immigrants who have not arrived in the United States via legal means or who overstayed their legal right of entry, TPS may be another program that is allowed to end, country-by-country.

Everyone needs to understand what a fiduciary is and how to select the best one for the tasks you need accomplished.

It is perhaps easiest to understand what a fiduciary is by providing examples. Someone who handles money that doesn’t belong to him is typically considered a fiduciary. Someone acting under a power of attorney, an executor under a will, a trustee, or an agent under a medical power of attorney, or even a lawyer under certain circumstances, are good examples. A fiduciary is someone who acts on your behalf when you are unable or unwilling to do so. Usually, this occurs when one of two situations are present: you die or competent.

If you are not competent to make your own decisions, you may need a fiduciary to handle:

The best solution for these situations is for you to plan. If you fail to do so, a judge may decide who will act on your behalf. Also, if you don’t plan, the person or company taking care of your matters may not be your best choice. In fact, it could be your worst choice, but because this person is more closely related to you or is persuasive before a judge, she may wind up in control.

So you should look at that list of four situations above and determine who you might choose to act in each one of them. Here are four suggestions to consider as you try to determine who might act as your fiduciary:

A significant portion of Americans now favor a crackdown on immigration. Some of these nativist attitudes are long-term. Some come from economic difficulties; others are based upon prejudicial attitudes.

Throughout America’s history, the groups who were prior settlers always had a significant portion among them that resisted new arrivals. Not all Americans welcomed immigrants with open arms throughout America’s nearly 250 year existence, despite the fact that aside from native Americans, this is a nation of immigrants.

Over the past two decades, studies and anecdotal evidence point to three concerns that have added to the nativists’ position:

These three concerns – September 11, the lack of economic security, and the lack of good jobs – have all added to the number of Americans who now favor restricting immigration. This has led to stricter enforcement of immigration laws, changes in the focus of immigration officials, and even the ending of the popular deferred action for childhood arrivals (DACA) program. Attitudes changed. It’s likely the feelings of American citizens will change yet again as these opinions vary from time to time.

The Trump administration ended the DACA program on September 5th. Many in the immigrant community are concerned and frightened. Let’s look at what happened and several steps you can take to alleviate your concerns and calm your fears.

The President did not make this announcement. Rather, he chose Attorney General Jeff Sessions, a noted immigration hard-liner, to briefly address the media, taking no questions afterwards.

Mr. Sessions noted that deferred action for the dreamers was ending, with the Department of Homeland Security allowed six months to transition the program to an end. This direction was given to the acting director of DHS, as currently there is no one serving as director, Mr. Trump having failed to nominate anyone to fill the role previously occupied by Gen. John Kelly, who is now the President’s Chief of Staff.

The announcement was sternly worded, referring to dreamers several times as “illegal aliens”, using the words “law” or “lawlessness” or “rule of law” in almost every sentence, focusing on legal justifications instead of the individuals involved.

So is it hopeless? What should a dreamer recipient or any member of the immigrant community do in this time of great uncertainty?

First, keep communicating with your attorney. Whether you work with our offices or another immigration lawyer, the worst thing you can do is to run away and hide. Remember that any attorney you retained to work for you cannot share information about you with the government. Your lawyer’s office is a safe place where you can talk freely.

Second, if your DACA is up for renewal before March 5th, unless and until we get further guidance, you may try to renew it so long as you do so by October 5 ^th . Due to mailing and processing time, our offices will be mailing any renewals before September 30 ^th . Renewal is a good idea. If any further steps are taken by Congress to protect dreamers, one of the first questions that likely will be asked is whether a dreamer was compliant with the prior rules. If you drop out of the DACA program, you may find yourself worse off. Unfortunately, no new DACA applications will be accepted.

Third, stay out of trouble! Don’t get a DUI. Don’t use or sell illegal drugs. And don’t fail to show up for court dates, even for something as simple as a traffic ticket. Do not give immigration authorities any excuse to deport you.

Fourth, plan for the worst. If you have children, make sure paperwork is prepared so that they can be cared for by other family if you are picked up by ICE. Make sure you have trusted family or friends that can handle any financial or other matters that may arise if you are taken into custody. Your attorney can help you draw up the correct documents.

Finally, don’t give up hope. Congress may act. This may be the push needed to deal with immigration in a more comprehensive manner. Several state Attorneys General intend to file actions to stop the enforcement of President Trump’s rescission of DACA. Whether this is ultimately successful, it may at least stop the process temporarily. And don’t forget even if you are a dreamer or any immigrant who does not have any legal status, there may be other avenues to help you gain temporary or even permanent legal status. It never hurts to see an immigration attorney to discuss what might be done to help your situation.

Deferred Action for Childhood Arrivals or DACA is an executive order issued during the Obama administration. It directs immigration officials to hold off any potential deportation proceedings against certain individuals who unlawfully entered or remained in the United States as children. To qualify for consideration under DACA, a person must have entered before age 16, be under age 31 as of June 15, 2012, stayed for at least five continuous years, are either in or have graduated from school, and have no criminal issues. This program has about 800,000 participants nationwide.

Several state Attorneys General, led by the Texas AG, have given the federal government until September 5 or they will bring proceedings to force an end to DACA. If sued, the Trump administration would then have to decide whether to defend a prior Obama executive order, choose not to defend it, or, the president could and the program abruptly by Executive Order.

If DACA ends, the participants could be turned over to Immigrations and Customs Enforcement (ICE) for removal or deportation proceedings.

There are two separate bipartisan bills pending – one in the House of Representatives and another in the U.S. Senate — that would grant some form of official status to the dreamers. Neither of these legislative efforts has progressed beyond the initial stages.

Much uncertainty exists. The president himself has made contradictory statements about the dreamers, at times indicating he would end the program, but at other times saying he wanted to deal with DACA recipients with compassion. At this time there isn’t any clear indication as to which direction he intends to go.

If you obtained your green card through marriage to a U.S. citizen or permanent resident, a divorce (or annulment) may pose a problem. Indeed, U.S. immigration laws make clear that only real, valid marriages qualify an immigrant for a green card. Your concern is understandable.

The good news is that there is nothing in the law saying that once you are divorced or your marriage is annulled, your efforts to get a green card are over. U.S. Citizenship and Immigration services (USCIS) recognizes that even couples who were once in love and committed to each other can have their relationship fall apart.

Because USCIS is always on the lookout for fraudulent marriages, a divorce may cause USCIS to take a second look at your case. How this is viewed depends upon what phase of the application process you are in.

Divorce After Approval of I-130 Visa Petition

If the only application filed in your case was a visa petition on Form I-130, filed by the U.S. citizen or lawful permanent resident half of the couple, then even if it was approved, that won’t help the immigrant after a divorce. The visa petition simply starts the immigration process, without providing the immigrant any rights to remain in the U.S. or to be admitted. So if your marriage ends in divorce or annulment at this stage, you will not be able to take further steps toward U.S. immigration.

Divorce After Approval for Permanent Residence

If you have already successfully applied for permanent residence (a green card), USCIS has no reason to take a second look at your application, so you need not worry. However, the only people who become permanent residents immediately after applying for their green card are those who were married longer than two years at the time they were approved for the green card.

Nonetheless, if you later apply for U.S. citizenship, you’re giving USCIS a reason to take another look at your file. See below.

Divorce After Approval for Conditional Residence

The usual way of filling out Form I-751 is by joint petition, signed by both spouses. The joint petition tells USCIS that the marriage is real and ongoing. After a divorce or annulment, however, you (the immigrant) will have to submit the petition on your own, asking for a waiver of the joint filing requirement. In order to do this, you will need to provide convincing evidence that the marriage started out as the real thing, even though it ended before you wanted it to.

When You Apply for U.S. Citizenship

If you apply for U.S. citizenship (to naturalize), USCIS will review your immigration file and perhaps your marriage information. If USCIS sees signs that the marriage that got you the green card was fraudulent — and divorce or annulment might be considered such an indication — it will require you to provide documentation proving that your marriage was legitimate.

If you are unable to come up with sufficiently convincing documentation, USCIS may not only deny your citizenship but refer you to immigration court proceedings for removal from the United States (deportation).

Spouses, parents and unmarried minor children of current or past U.S. military service members may obtain legal permanent residence, even if these individuals had unlawfully entered the United States. Parole in Place allows these family members to secure legal status in the U.S. Without such status, spouses, parents and children of servicemen and women could be deported and subjected to a 3 or 10 year bar on re-entry to the U.S., an especially terrifying prospect for military members who are on active duty and away from family. To allay these concerns, these family members may apply for permanent status under Parole in Place.

There are limitations. Individuals with a criminal conviction or other serious adverse factors will not be granted relief. Moreover, the decision to grant the petition is discretionary. Therefore, the assistance of an experienced immigration attorney is helpful in properly preparing the paperwork, gathering the evidence to support the request, and presenting it at the hearing.

Once Parole in Place is granted, the immediate family member cannot be deported or removed and is viewed as being retroactively admitted to the United States.

You loaned your car to your daughter. She’s a good driver. And your car made it safely back home. No scratches, dents or other evidence of careless driving.

Several weeks later, you get an envelope in the mail. In it is a citation for failing to stop at a red light before making a right-hand turn. One of the villages along the route where your daughter was driving when she borrowed your car had a camera at that intersection. The paperwork tells you where you can view the video of your vehicle rolling through the red light. The notice has a fine you pay by mail – perhaps $100 – and also a date where you can contest the violation.

The document tells you what defenses are allowed to protest the imposition of the fine. The fact that someone else was driving your car? That isn’t listed.

Because the camera that recorded the failure to stop doesn’t clearly show the driver, the fine is levied against the person who owns or leases the car – not the driver. The good news is that this isn’t a moving violation. It would be hard to affect the license of a driver when you cannot determine who the driver is!

If you do have a defense, however, should you pursue it? You are given a date for a hearing. You can appear on that date and tell your reasons for why the fine should not apply to you. The question of whether to go to the hearing is an economic one. If it’s going to cost you more money to take off work, or hire an attorney to represent you (which you are free to do of course), you may choose to not attend the hearing and grudgingly pay the fine instead.

But, should you have your daughter pay the fine? That’s a discussion for the two of you to have!

You have retained an attorney or are employing a non-for-profit agency to assist you in an immigration matter. Perhaps you are applying for deferred action for childhood arrivals, a UVISA, or asylum in the United States. You met with the person or persons assisting you and yet it seems like a long time has passed. You are nervous.

There are a number of reasons why an immigration matter may take considerable time to resolve. Here are three of the more common situations:

First, did you cooperate with the attorney’s office or the non-for profit? Often, persons with an immigration matter are given checklists or told what documents, information, photographs, etc. that need to be provided. Unless you submit all information to the office or agency helping you, they may not even be able to prepare an application or file a case. The delay may be due to your inability or unwillingness to help them help you.

Second, have you met all financial requirements so that your case or matter can move forward? Often, USCIS or other government agencies or courts have filing fees or other costs that you need to pay. If you have retained an attorney for help, check the retainer or fee agreement that the office provided you. If it is a non-for profit that is assisting you, review the paperwork they gave you.

Third, the particular government agency or court handling your matter may be backlogged with cases, understaffed or simply choosing to prioritize certain immigration matters over others. Once a case or petition is filed with the appropriate court or government agency, there is usually little that an attorney or not-for-profit organization can do to expedite the process. You may simply be in a line of many others with similar requests awaiting your turn.

The Defense Department may terminate a program that has allowed immigrants without status to serve in the military and in return have the opportunity to obtain US citizenship. The Military Accessions Vital to National Interest or MAVNI program allowed non-citizens with useful linguistic or medical skills to join the US military.

Despite the fact that these individuals have been vetted when entering service, the Pentagon now believes these persons pose a potential threat and have assigned threat levels to the 10,000 individuals currently in the program. The Defense Department also plans to subject approximately 4100 service men and women who already are naturalized citizens to enhanced screening. Commentators, including a retired lieutenant colonel (and attorney)who supervised this program, believe this in and of itself may be unconstitutional.

Although most of these individuals have serve the Army, their skills have been utilized by all branches of the service and continue a tradition dating back to the Revolutionary War.

In January, the Obama administration enacted an executive order, known as the International Entrepreneur Rule, which was to go into effect this month. The rule would have permitted an entrepreneur to enter the United States if they could prove that they had secured $250,000 In funding from American investors or $100,000 in grants, with which they could start their companies.

The Trump administration announced yesterday that it was delaying implementation of this rule and was seeking instead comment on a plan to rescind it.

Trade associations, especially those involved in high-tech industries, are disappointed in this action. Immigrants have built innovative companies that generate economic growth and jobs. In fact, there are nearly 50 immigrant-founded startups now worth in excess of $1 billion, creating an average of nearly 800 jobs each.

The International Entrepreneur Rule would have permitted the founders of the startups 30 months to grow their business, with potential for additional extensions of time. Praised at the time as a “start-up Visa”, it now appears as if this program will be a nonstarter.

A power of attorney (POA) is a written authorization to act on another’s behalf. The person naming the other to act is called the principal and the one authorized to act is called the agent or the attorney-in-fact.

The person who creates a power of attorney — the principal — can only do so when he or she has the requisite mental capacity. Thereafter, if the principal loses capacity to make decisions after the power of attorney has been created (for example, from Alzheimer’s disease or a head injury in a car crash), then the agent may take over, assuming the power of attorney is drafted correctly.

If a person does not have the capacity to execute a power of attorney (and does not already have one in place), often the only way for another party to act on their behalf is to have a court appoint and supervise a guardian. Consequently, these documents need to be in place before any future incapacity.

There are two types of powers of attorney commonly used: one for property or management of financial affairs, and one for health and personal care.

On June 15 ^th , the Department of Homeland Security (DHS) announced that it was rescinding a memorandum that would have provided a program allowing deferred action against parents of American citizens and Legal Permanent Residents, known as DAPA. DAPA was never implemented. An injunction filed in federal court several years ago prevented DHS from moving forward with it.

DPA would have allowed parents of citizens or legal permanent residents who continuously resided in the US since January 1, 2010, and were present within the country as of November 20, 2014, and who had no lawful status, to apply for deferred action by DHS.

In its decision to no longer pursue DAPA, DHS stated that this change did not affect those currently protected under the Deferred Action for Childhood Arrivals or DACA program. Work permits issued under DACA will also continue until their termination dates. DHS did note that it now has new enforcement priorities, citing this as one reason for abandoning DAPA.

The continuation of DACA, although not affected by this notice, is still under review. The President has stated conflicting and ambiguous views on this program. It is important to pay attention to any changes that may be forthcoming in immigration policy.

An Executive Order signed by President Donald Trump on February 27 ^th of this year has immigration advocates concerned about its possible effects on expedited removal. In the past, expedited removal was limited to areas within 100 miles of the US border and only to newly arrived undocumented aliens. The order directs DHS to expand expedited removal, leading commentators to suggest it could impact persons in the interior parts of the country, as well as those who have been in the US for some time.

Expedited removal allows low-level immigration officials to act in lieu of judges to decide if a person should be expelled from the US. These deportations do not allow for any appeals or other rights to challenge the decision. Moreover, persons in custody rarely retain an attorney to represent them. The result is often quick and brutal.

One group in particular that may be harmed are those coming to America seeking asylum. These individuals need to demonstrate a credible fear of being returned home. This fear is often a result of a traumatic incident or series of incidents. Although immigration officials shouldn’t deport someone who may have a valid asylum claim, without access to counsel, without an understanding of the principles of asylum, and without more oversight of the process, concerns exist that that expanded expedited removal may snare many otherwise deserving asylum seekers.

The Illinois House passed the TRUST act. This proposed law forbids local police from assisting in immigration detention without court-ordered warrants. Local law enforcement would also be prohibited from stopping, searching or arresting anyone based on their immigration status.

This will also retain the distinction between the authority of local police to maintain safe communities, and the mission of federal immigration officials.

According to a press release from National Immigrant Justice Center, this proposed law is expected to pass the Illinois Senate, and will shortly await signature by the governor. At this point, it is unknown as to whether the governor will sign the TRUST act into law. Nonetheless, this first step is welcomed by a broad coalition of immigrant advocacy groups who urged its passage.

The number of minors, coming largely from countries such as Guatemala, El Salvador and Mexico, who are being granted Special Immigrant Juvenile Status has grown over the past several years. But, according to the San Diego Union Tribune, Congress is considering tightening eligibility for this program.

An undocumented immigrant child who can show that he or she has been abused, neglected or abandoned, and therefore cannot return to his or her home country, can been allowed to stay if a judge grants Special Immigrant Juvenile Status. Then, the child may later be able to petition for an adjustment to permanent legal residency. The program is popular, growing from 1,869 petitions granted in 2011 to 8,739 in 2015 and 15,101 in 2016. Also, the program is a successful one. Only 594 petitions were denied last year.

The first law Congress is considering would prohibit this status if a child has a parent, close relative or sibling in the United States. The second would require a child to prove he or she has been abandoned by both parents before the child could be granted Special Immigrant Juvenile Status. Both changes have been criticized by immigration advocates as weakening protections for children who may be otherwise sent back to parents or relatives who have abused them. These cases are typically decided by judges who are expert in making determinations as to what is in the best interests of a child.

Neither of these attempts to change the law have been enacted. As of now, the program allowing minors to seek Special Immigrant Juvenile Status remains in effect unchanged.

Those who represent the immigrant community – immigration lawyers, advocates and organizations – have long cautioned against displays that could be construed as gang related. Avoid posting images of tatoos, clothing or gestures that could be misinterpreted as being gang symbols. Pictures, videos and drawings on Facebook, Snapchat or Twitter could be presented as evidence in a court proceeding for deportation, asylum or other immigration case. Be sure to monitor social media usage by other members of your family, especially children.

Use common sense. Although you don’t want to stifle the creativity and enjoyment you may receive from participating on Facebook and similar sites, be aware that it is easier to keep a lower profile and to double check something before you post it. Know that deleting a post, a picture or a video does not make it go away, as social media websites retain copies of deleted posts that can be retrieved by authorities. When in doubt, don’t put it out!

Roberto Beristain’s temporary home is a shelter, operated by the Catholic Church, in Juarez, Mexico. Until recently, Roberto had lived nearly 20 years in the United States with his US citizen wife and three children. The reporting of his deportation story on a recent episode of CBS’ 60 Minutes, has rekindled debate amongst all sides of the political spectrum on current immigration policies.

Helen, Roberto’s wife, met him in 1998 when Roberto was a busser at a restaurant in Fort Wayne Indiana. They married and have three children, ages eight, 14, and 16. Home for the Beristain family is Granger, Indiana, a community of about 30,000 near the Indiana–Michigan border.

When Helen was pregnant with their first child, she became ill on a trip with Roberto to Niagara Falls. Confused, they made a wrong turn and wound up having to cross the border back into the United States from Canada. Unlike Roberto’s first crossing into the United States from Mexico, he was questioned by border agents. He was released when he agreed to sign an order for voluntary departure. Because he did not leave the United States, that order later ripened into an order for removal or deportation.

Roberto was allowed to remain in the United States, dutifully checking in at prearranged times with immigration authorities. Over time, he acquired a Social Security number, a temporary work permit, and worked his way from busing tables to owning Eddie’s Steak Shed. At this local restaurant in Granger, Roberto employs 20, where a number of the regulars are dismayed at his current situation.

Despite the fact that Roberto has no issues with the law – except for his border crossing from Canada – when he arrived at the immigration office in Indianapolis for his annual check-in, an ICE officer informed his wife that he was being detained.

Subsequently, Roberto was deported to Mexico, where he now chats with his children about school and family issues by phone. He keeps a positive attitude. His wife has retained an immigration attorney to try to rectify the situation. His children are confused, although his middle child – 14-year-old Jasmine – now wants to become an immigration lawyer.

Statistics show that the number of people being detained and deported has increased under the new administration in Washington. According to 60 Minutes, it costs an average of $11,000 for each person the United States government deports. Since late January, ICE notes that it is arrested 21,000 undocumented immigrants, nearly a quarter of whom have no criminal record. Of the 11 million undocumented in the United States, approximately 3% have felony convictions. The shift in priorities from removing individuals with felonies to those who apparently comply with immigration, is confusing to many. Although the situation may appear grim, cases like Roberto Beristain show that many US citizens are sympathetic to individuals who work hard, raise a family and are assets to their community and to the US economy as a whole. Immigration attorneys remain willing and able to help those who are concerned about these issues, from simply providing information to assisting with defense against removal proceedings.

The Trump administration has attempted to implement policies based upon its anti-immigration rhetoric in a number of ways. Some – building a border wall with Mexico, punishing sanctuary cities by a loss of federal funds, and bans on travel to the US – have stalled due to court actions or a reluctant Congress. But one tool utilized is effective: fear.

Federal agents arrested 21,362 immigrants from January through mid-March of this year, compared to around 16,000 a year ago. Also, persons apprehended by Customs and Border Patrol Agents at the Mexican border dropped to around 12,000 per month from an average of 40,000. [Nakamura, D. On May 1 ^st , as people gather around the country to protest Trump policies – including actions on immigration – many in the immigrant community wonder if there are ways to calm their anxiety and uncertainty. Here are three suggestions:

First, understand your rights. Even if you are undocumented, you need not open the door to an immigration officer unless he or she has a warrant. Speak to the officer through your door, and if he or she claims to have a warrant, ask him or her to slide it under the door so that you can examine it first. Also, you need not say anything. Be cautious of what you do say, as it can be used against you. But do not lie. And if you do not understand a question, do not nod your head or appear as if you agree with an officer. Politely inform him or her that you do not understand the question, whether due to the language being used or the words themselves.

Second, have a plan in case something unexpected happens. If you are taken into custody, you may not have the time or ability to notify family and friends. Have paperwork in place that gives other, trusted persons the authority to take care of your children. Put the app on your cell phone that automatically notifies your family, friends and attorney at the push of a button that you have been arrested and may be in detention.

Third, seek assistance from trusted sources. Do not rely upon gossip or stories in the news that may not be true. Sadly, immigration authorities used to be helpful. Now, enforcement is the new priority, destroying trust that officers had built in many areas. Get information and advocacy from not for profit organizations and immigration attorneys, preferably ones that you are referred to by your friends and family. If you retain an attorney, understand that he or she cannot divulge anything you tell him or her in confidence. Know that immigration proceedings are now taking longer and if your attorney or an organization is helping you, you need to be patient, as things are slower than they were even a few months ago.

Times have changed. Although fear is a powerful force, you can take steps to combat it!

The United States Customs and Immigration Service (USCIS) is ending the designation of temporary protected status (TPS) for beneficiaries from the countries of Guinea, Liberia and Sierra Leone. This designation will terminate on May 21, 2017. USCIS had given notice as required several months in advance.

These countries were originally designated for temporary protected status due to the Ebola virus. The Department of Homeland Security has determined that these conditions no longer warrant the TPS designation.

Although this termination does not affect any other immigration status that these beneficiaries hold, individuals without lawful immigration status (other than the expiring TPS) will no longer be protected from removal, nor will they be eligible for employment authorization after May 21 ^st .
