How Immigrant Victims of Crimes Can Obtain Legal Status Under U Visa

U Visa encourages immigrant victims of crimes to report these crimes to authorities. Thereafter, the victim may petition for temporary legal status in the United States. Successful applicants may also obtain employment, be eligible for permanent status, and help other family members obtain legal residency.

How Do I Obtain a U Visa?

To be eligible for a U Visa, you must meet the following requirements:



  • You must be the victim of one of a list of specific crimes;
  • Due to the crime, you suffered substantial physical or mental abuse;
  • You have information that is useful about the criminal activity you encountered;
  • You were, can be or will be helpful to authorities prosecuting or investigating the crime; and
  • The particular crime violated U.S. law or was committed within the U.S.

If you are under the age of 21, then you can apply for your spouse, children, parents or unmarried brothers and sisters under 18; if you are over age 21, you can apply for your spouse and children.

Can a U Visa Lead to Permanent Status?

Yes. Under certain humanitarian grounds, you may be eligible for permanent status after three years.

There are no filing fees for the U Visa, although you may incur other costs.


You can apply even if you have a deportation pending.
